Terms and Conditions
Travel Now Pay Later™ is a registered trade mark of Players Vacation Club, Inc (PVC) and is a convenient and secure payment method designed for purchasing on the web or over the phone. PVC does not issue a credit line. To enhance your convenience, security and buying power, PVC approves and extends credit for each transaction based on the select packages we provide.
Member Services that PVC provides include the following: financing of up to 80% on select air and hotel packages, land-only condominium, cruises, and other vacation specials listed in our membership materials. The vacations to choose from include three to seven night stays for two people traveling together on the same itinerary and sharing one room with the exception being our land-only Condominium Resort packages which feature one to three bedrooms.
A deposit from 20% to 30% is required at the time your travel request is sent. Rate increases and black out dates may apply due to conventions, holidays and other heavily trafficked times. Rates and destinations are subject to change without notice. To receive financing on our listed vacation packages we must receive a 45 day advance notice from your travel dates. Special requests will be considered.
IF upon your first vacation request
the pricing and credit amount financed is over $1,500 (after deducting the deposit amount), we may request credit reports or additional deposit monies in connection with this first vacation request. An initial higher credit amount of up to $2,500 may be considered and granted based upon annual income; length of time employed; and credit references. As you establish a good payment history with us, you will have greater chances of being approved for each requested purchase.
CREDIT PAYMENTS:
Credit is issued on vacation packages and membership fees to Members who agree to have their checking accounts electronically debited for repayment of the credit extended on a monthly basis as listed in our membership materials. All purchases are interest free. Payment terms range from 10 months to 18 months depending on the vacation chosen and a separate promise to pay agreement between PVC and the member will be sent for signature for each vacation financed by the member.
DESCRIPTION OF MEMBERSHIP AND REQUIREMENTS:
Membership is provided by Players Vacation Club, Inc., a Nevada corporation, providing a service called Players Vacation Club, “PVC,” and PVC Travel Program. Membership is available to any individual who agrees to the terms and conditions of membership, is a U.S. resident, qualifies with a combined household income of over $2,200 a month, has had a valid U.S. bank checking account for six months, is over 18 years of age, and has paid the necessary fees for enrollment. Membership shall remain valid so long as annual membership dues are paid, the use of any credit extended member has been paid in a timely fashion, and the financial information provided by the member is factual and correct. Incorrect or misleading information which results in PVC denying vacation financing will cause a forfeiture of any membership refunds.
Enrollment Fees:
Your membership is effective immediately following your enrollment date. The initial payment will be charged immediately upon completion of the enrollment form. All members agree to have their account of record automatically debt for membership fees required upon acceptance of these terms, as listed on the order form, and prior to financing approval on any product or service. PVC reserves the right to change the terms of the membership fee at any time and without notice.
Cancellation and Refunds:
Refund Policy: In order to cancel all members must call member services toll free at 877.532.2800 9am-5pm PST (west coast) or mail a handwritten request to the address listed under the contact us form of the website. Memberships can be cancelled within 30 days of the initial sign up date and receive a full refund of membership dues. If your account was processed via ACH, and paid, your refund will be issued by ACH directly into your account within 3 business days of cancellation. Cancellations that are done after 30 days are entitled to prorated refunds and are determined by how long the membership is active. Renewals will be refunded in full for up to ninety days from the date of payment(s).
Credit Cards: Members that join using Credit Cards / Debit Cards will be refunded back to the Credit Card / Debit Card within 3-5 business days from the cancellation date. .
Check Drafts: In some instances we will process your member fees using check drafts rather than ACH when the checking routing and account number are provided. These drafts will appear on your bank account as a preauthorized check including our designated check number. In these instances the refund process will be 14-21 business days and issued to you via USPS in check form..
There are no cancellations permitted while currently financing a product or vacation with us. Once the purchase agreement is paid in full you may request a cancellation of the membership, but it will not be done automatically as most members choose to use our services multiple years.
Returned and NSF ACH Payments:
In the event that your membership fee is returned due to non-sufficient funds, PVC may immediately attempt to collect the full amount by presenting the ACH authorization a second time to your original banking institution. Any or multiple NSF’s on member fees may prompt PVC to disqualify you from financing privileges or increase the deposit amount required at the time of your request at PVC’s discretion.
Membership Terms:
Your membership is effective for a period of twelve months following enrollment date under the annual membership plan. RENEWAL will be on an annual basis. Each year your annual dues will be automatically debited from your checking account on file with us, unless you notify us otherwise. A written notification and reminder will be mailed to you thirty (30) days prior to your renewal date. Upon renewal, you will be issued a new membership materials and continue to have access via the internet. This is known as a Continuity Plan. We reserve the right to increase or decrease the Renewal Fee for each new Membership Term.
AMOUNT OF CREDIT:
the Installment Purchase agreement extended to the member shall not exceed $3,000 at any given time. The amount of Credit issued is based on the vacation package purchased as listed in our materials and calculating the remaining balance after payment of the reservation deposit. The Credit limit is not intended to be used like a normal credit card. The credit limit allows a member to make payments on a vacation previously taken and then using the remaining balance for financing on additional vacations.
Documentation Requirements :
For your first credit request all members financing any product or service may be required to provide to our finance department the following documentation for Identity, Residence and Employment verification purposes only: 1. Photocopy of valid state issued drivers license or identification card. 2. Photocopy of your federally issued social security card. 3. Photocopy of a current utility bill in your name and showing your current address. 4. Photocopy of a current pay stub in your name and showing a minimum of 6 months of employment. 5. Photocopy of a current bank statement in your name and reflecting a positive balance. Our finance department reserves the right to require the submittal of any additional forms of identification and or residential and employment documentation not stated here that it deems necessary to satisfy the above stated requirements for loan approval. If the documentation sent by you fails to satisfy these requirements to our satisfaction we reserve the right to refuse financing to anyone at anytime. The above requirements are meant to protect you the member and us against Identity theft and fraud.
A separate Installment Agreement will be mailed to you upon receipt of deposit that will require your signature along with other documentation request. Your travel request will not be booked until the Installment Agreement is returned to our 501 W. Broadway Plaza A -321 San Diego, Ca 92101 address.
DEFAULT ON ACCOUNT:
will be in default if:
a) I fail to pay the “monthly payment” when due; or
b) I breach any of the Terms and Conditions of the Purchase Agreement.
If I am in default, then upon compliance with applicable law, PVC has the right to: a) demand me to pay the entire unpaid balance on the account immediately; b) apply monies received on subsequent purchases to any delinquent account balance owed including late fees if applicable; and/or c) proceed with legal action.
CONSUMER CONSENT.
By checking the “I agree to have the Terms and Conditions presented electronically”, which I hereby adopt as my electronic signature, I consent and agree that:
- You can provide disclosures required by law and other information about my legal rights and duties to me electronically.
- My electronic signature on agreements and documents has the same effect as if I signed them in ink.
- You can send important communications and disclosures to me electronically to the email address that I have provided to the Merchant in this transaction or to another email address that I provide to you for that purpose.
USAGE:
of the member financing is only for the member listed on the membership card. You agree that you will use PVC only for your own behalf and for the members of your immediate family who are residing in your household. . PVC allows only one membership per household A limited number of itineraries are available for departure per day each year. Providing alternate travel dates will help us confirm your selected destination.
RESPONSIBILITY AND LIABILITY:
PVC shall have no liability in regard to any services provided by any vendor. You agree that any claim with regard to travel services shall be made against the vendor of such services and not PVC; PVC’s sole obligation hereunder shall be to forward to the vendor all payments for services ordered and forward to you all the necessary travel documents. The hotels, carriers and other travel providers which supply services in connection with these vacations are independent contractors and are not agents of PVC. All coupons, receipts, passes, and tickets issued by hotels, carriers and other suppliers are issued on the terms and conditions specified by the suppliers. PVC does not have the authority to alter those terms. PVC is not responsible for personal injuries, loss or damage of property, inconvenience or expense resulting from matters beyond its control, such as, acts of terrorism, defects in vehicles, breakdowns in equipment, government actions, strikes, theft, changes in itinerary or schedules, inclement weather and acts of God. PVC may, in its sole judgment, make any changes and cancellations to vacation programs and schedules that it believes necessary. Individual programs and travel benefits within the PVC membership program may be subject to separate terms and conditions and may be altered or substituted with products or services of equal or better value without prior notice to a member.
STATE NOTICES
NOTICE FOR CALIFORNIA RESIDENTS:
California law requires that we inform customers that should they fail to fulfill the terms of their credit obligation, a negative report reflecting on their credit record may be submitted to a credit-reporting agency. If you are married, you may apply for credit in your own name.
NOTICE FOR FLORIDA RESIDENTS:
You (borrower) agree that, should we obtain a judgment against you, a portion of your disposable earnings may be attached or garnished (paid to us by your employer), as provided by Florida and Federal law.
NOTICE FOR OHIO RESIDENTS:
The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law. |
